Order approval

The sale of products takes effect upon receipt of a purchase order accepted by SoftLux and/or upon the signing of the SoftLux purchase order by the customer.

No order will be processed without full payment.

Sales prices

All prices are valid for thirty (30) days from the date of the quote. After that, prices may be adjusted to reflect the current SoftLux pricing at the time of delivery, unless otherwise agreed to in writing by both parties.

Prices do not include applicable taxes and/or duties.

Order delivery and storage

Le Client s’engage à prendre livraison de l’ensemble du matériel commandé dans un délai maximal de trente (30) jours suivant la date de livraison convenue, que cette date soit antérieure ou postérieure à la date initialement demandée par le Client.

En cas de demande de report de la livraison par le Client au-delà de ce délai de trente (30) jours, Softlux se réserve le droit de :

• facturer l’intégralité du montant de la commande, incluant les taxes applicables, à compter de la date prévue de livraison, et
• imposer des frais d’entreposage mensuels, équivalents à 1 % de la valeur hors taxes du matériel concerné, pour chaque mois de stockage entamé.

Il est précisé que Softlux n’a aucune obligation de stocker le matériel pour le compte du Client, et que ce service est offert à titre discrétionnaire. En l’absence de prise de livraison par le Client dans un délai raisonnable suivant la mise à disposition, Softlux se réserve le droit, à sa seule discrétion, de disposer du matériel non récupéré, sans préavis ni indemnité au Client.

Shipping and delivery dates 

SoftLux will make every effort to meet the delivery date requested by the customer. However, the customer acknowledges that delivery dates for custom orders may vary and are beyond SoftLux's control. As such, the customer agrees that SoftLux shall not be held liable for any delivery delays, whether caused by SoftLux or a third party, and acknowledges that SoftLux does not guarantee delivery of the materials on the requested delivery date.

The customer further acknowledges and agrees that all shipping costs will be paid by the customer to SoftLux, according to the payment terms agreed upon by both parties, and that any third-party shipping is at the customer’s own risk and expense, regardless of whether SoftLux arranged the transport on the customer’s behalf.

SoftLux does not guarantee delivery or shipping by third parties, including but not limited to service quality or timely delivery of materials.

Warranty

No warranty is offered on products that have already been applied and/or used.

Applied microcement may present some texture and colour variations. These are inherent characteristics of the product.

The warranty and liability of SoftLux are in all cases limited to the repair or replacement of the products. At all times, the customer and installer must inspect the product before installation. SoftLux will not be held liable for any claims once the product has been installed. It is the customer’s responsibility to ensure that installation is carried out by a qualified installer and in accordance with the manufacturer’s instructions.

Return and exchange policy

• All returned merchandise must be in its original condition and must not have been used or installed.
• No returns will be accepted for custom orders or clearance items.
• The original copy of the invoice is required.
• Returns or exchanges are accepted within thirty (30) days of the delivery date, in the original packaging.
• Return fees of up to 25% may apply and are the responsibility of the customer.
• Refunds will be issued using the original payment method.
